Yes the same realtime LSM patch for 2.6.12 and 2.6.11 works with 2.6.13.

And rtlimits is standard with 2.6.13 but none of the distros that ship
2.6.13 have updated their userspace yet so it's very difficult to use
for now.

Yes this is a bug and should be reported as such.
